RESTRICTIONS ON USE OF MATERIALS.
This site is owned and operated by Disney Online (referred to as "Disney", "we", "us", or "our" herein). No material from Disney.co.uk or any Web site owned, operated, licensed or controlled by Disney may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except that you may download one copy of the materials on any single computer for your personal, non-commercial home use only, provided you keep intact all copyright and other proprietary notices. Modification of the materials or use of the materials for any other purpose is a violation of Disney's copyright and other proprietary rights. For purposes of this Agreement, the use of any such material on any other Web site or networked computer environment is prohibited. All trademarks, service marks and trade names are proprietary to Disney Enterprises, Inc. and Cap Cities/ABC, Inc.
In the event you download software from the site, the software, including any files, images incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") are licensed to you by Disney. Disney does not transfer title to the Software to you. You own the medium on which the Software is recorded, but Disney retains full and complete title to the Software, and all intellectual property rights therein. You may not redistribute, sell, decompile, reverse engineer, disassemble or otherwise reduce the Software to a human-perceivable form.
Disney is pleased to hear from its loyal fans and welcomes your comments regarding Disney products, including Disney's on-line services. Unfortunately, however, Disney's long-standing company policy does not allow it to accept or consider creative ideas, suggestions or materials other than those it has specifically requested. We hope you will understand that it is the intent of this policy to avoid the possibility of future misunderstandings when projects developed by Disney's professional staff might seem to others to be similar to their own creative work. Accordingly, we must, regretfully, ask that you do not send us any original creative materials such as stories or character ideas, screenplays, or original artwork. While we do value your feedback on our services and products, we request that you be specific in your comments on those services and products, and not submit any creative ideas, suggestions or materials.
If, despite our request that you not send us any creative materials, you send us creative suggestions, ideas, notes, drawings, concepts or other information (collectively, the "Information"), the Information shall be deemed, and shall remain, the property of Disney. None of the Information shall be subject to any obligation of confidence on the part of Disney and Disney shall not be liable for any use or disclosure of any Information. Without limitation of the foregoing, Disney shall exclusively own all now known or hereafter existing rights to the Information of every kind and nature throughout the universe and shall be entitled to unrestricted use of the Information for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Information.
Unless otherwise specified, the materials in the site are presented solely for the purpose of promoting programs, films and other products available in the United States, its territories, possessions, and protectorates and the United Kingdom. This site is controlled and operated by Disney from its offices within the State of California, United States of America. Disney makes no representation that materials in the site are appropriate or available for use in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. Software from this site is further subject to United States export controls. This agreement is effective until terminated by either party. You may terminate this agreement at any time by destroying all materials obtained from any and all Disney site(s) and all related documentation and all copies and installations thereof, whether made under the terms of this agreement or otherwise. This agreement will terminate immediately without notice from Disney if in Disney's sole discretion you fail to comply with any term or provision of this agreement. Upon termination, you must destroy all materials obtained from this site and any and all other Disney site(s) and all copies thereof, whether made under the terms of this agreement or otherwise.
THE MATERIALS IN THIS SITE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, DISNEY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LIMITATION OF LIABILITY.
Under no circumstances, including, but not limited to, negligence, shall Disney be liable for any special or consequential damages that result from the use of, or the inability to use, the materials in this site, even if Disney or a Disney authorized representative has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall Disney's total liability to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence) or otherwise) exceed the amount paid by you, if any, for accessing this site.
This agreement shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except in writing, signed by both parties.
The Internet is a fun place for work and for play. However, in order for you to get the best possible use from our sites it may be necessary, in some circumstances, for you to give us personal information about yourself. This policy tells you how we collect information from you, how we protect it and how we use it. We want to help make the Internet a safe and fun experience for you, your friends and your family. Disney.co.uk is owned, controlled and run by the Buena Vista Internet Group, part of the Walt Disney Company group of companies ('Disney' for short). It is Disney's policy that we obey and respect the law in relation to privacy and protect our guests' personal information from possible misuse. We also allow you access to your personal information so that you can amend or delete the information we have about you or ask us to do it for you.
What type of information we collect about you?
We collect two 'types' or categories of information about you:
What we do with 'Aggregate' information
Aggregate information allows us to see what 'types' of people use our site (for example, how many are girls and how many are boys). From time to time we may also run on-line surveys or questionnaires to collect your thoughts, opinions or suggestions as to how we can make our sites, products or services better for you. We may also share aggregate information with our advertisers, business partners, sponsors and third parties, so that they can better understand what type of person uses our sites. Remember, this information is NOT personally identifiable information from which you can be identified. What we do with Personally Identifiable information We will only collect personally identifiable information during the following: 1. When you register to enter into our on-line competitions 2. When you register for on-line 'clubs' that will give you special benefits like exclusive content, access to other competitions and other on-line activities.
This information is then used to inform winners of a competition what prizes they have won, or depending on your age, to inform you of other exciting events happening in the world of Disney. This personal information is ONLY used by Disney and it's affiliates and is NEVER shared with third parties, unless otherwise clearly stated at the time of collection or registration. Even then, it would only be shared when we have your permission to do so. When we post information about you on our sites, (for example, if you are a competition winner), we will never disclose personally identifiable information that could let other people know where you live or exactly who you are.
Our Legal Obligation to Disclose Personal Information we hold about you
The only time we will ever disclose personal information about you without your prior consent is where we have reason to believe that disclosing this information is necessary to identify, get into contact with or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Disney's rights or property, or anyone else who could be harmed by those activities. We may disclose memberinformation when we believe in good faith that the law requires it.
Disney Policies for individuals under 13 years old
Disney encourages parents and guardians to spend time on-line with their children and to participate in the interactive activities offered on these sites. When guests of this age register with us, we will send a message to your parents asking their permission to retain any information you give us. No information should be submitted to or posted to Disney or any Disney affiliate without consent of the relevant parent or guardian. No personal information collected from you if you are under 13 is used for any marketing or promotional purposes, either by Disney or it's affiliates. If a guest wishes to have information about our site updates, we will only send this information to their parent or guardian, and only if the parent or guardian has given us consent to do so. Such site update information will be sent directly to the parent or guardian. What we do with your information if you are 13 to 18 years old When guests of this age register with us, we will send a message to your parents asking their permission to retain any information you give us. No information should be submitted to or posted to Disney or any Disney affiliate without consent of the relevant parent or guardian. If you are between 13 to 18 years of age, we may, if you ask us, send you information or keep you informed about new activities on our web-sites. If you do register with us, you will receive an e-mail confirming your registration. What we do with your information if you are 18 years old or over If you are 18 years of age or older, you may request to receive information about new content or events on our sites or about other Disney products or services.
Our registration policy
If you do register with us, you will receive an e-mail confirming your registration. In addition, if you are under 18 and you register with us, your parent(s) or guardian(s) will receive an e-mail informing them that you have registered. Because this personally identifiable information belongs to you, you can ask us to delete it, modify it, or remove it from any or all of our mailing lists. Our general rules when you enter one of our on-line competitions All competitions that you may enter on our sites have there own rules and conditions, but for any of our competitions the following general rules will apply: If you under age 18, you can enter our contests, but only if you have the permission of your parent or guardian. If you win a prize we will tell you either by e-mail or through the post. The prizes will be sent to your parents or guardians. If you enter or win a competition, and we discover that you do not have the proper permission then your entry will be ignored or invalid, as will be the offer of any prize. What you can do if the information we have about you is wrong or you want to delete your registration or you want to de-register It is our responsibility to make sure that the personally identifiable information we have about you is correct and up to date. We also want you to have the ability to access and change the information we have about you and also to give you the option of de-registering from our subscription. You can do this at anytime by clicking on the modify details link present throughout the website. For instance the registration screen has a modify link which requests entry of your member name and password and then display al the personal data we have on you. If you are under 18 your parent also has access to this screen.
How we track your use of our site(s)
In order to continually improve our web-site it is useful to know which are the popular areas on our sites and how long our guests spend on them. We do this in a number of ways. These are explained below.
Use of IP Addresses
An IP address is a number that's automatically assigned to your computer whenever you're surfing the web. Web servers, the big computers that 'serve up' Web pages, automatically identify your computer by it's IP address. Disney collects IP addresses for the purpose of system administration, and to create reports and to audit the use of our site. When you request pages from Disney sites, our servers or computers log the guests IP addresses. We do not link IP addresses to anything personally identifiable, which means that a memberremains anonymous to us.
Links to other sites
The importance of secure storage of your personally identifiable information is of utmost concern to us. We exercise great care in transmitting your information from your computer to our servers. Only those employees who need access to your information in order to do their jobs are allowed access. Any employee who violates our privacy and/or security policies is subject to disciplinary action, including possible termination and civil and/or criminal prosecution. Your subscription details are password protected so that only you and Disney can access it and view the member information, delete, amend or cancel your registration. We recommend that you do not divulge your password to anyone. We will NEVER ask you for your password in an unsolicited phone call or e-mail. Ultimately, you are responsible for maintaining the secrecy of your passwords and any account information. Remember to sign out of your Disney site and close your browser window when you have finished what you've been doing; this is to ensure that others cannot access your personal information and correspondence if your computer is accessible to others or if you share with someone else or are using a computer in a public place like a library or an internet café.
Your acceptance of these terms
By using this site, we assume that you have read this document carefully and understand and have followed it's advice. If you do not agree to this policy or to the advice we give, please do not use our sites. We reserve the right to make changes to this policy from time to time as necessary. Your continued use of this and other Disney sites following the posting of any such changes to these terms will mean you accept those changes.
